Terms and conditions
English pages summarise the Dutch originals; where texts differ, the nl version prevails. Algemene voorwaarden
In brief
- A booking is firm once you accept our written quote and pay the 25% deposit.
- Free cancellation or rescheduling is available until 7 days before the session; later dates follow article 6.
- Guide hourly rates are on the site (e.g. vocals €95, band €115); your quote prevails.
- We keep project files for 6 months; mixing and mastering include 2 revision rounds unless agreed otherwise.
1. Scope
These terms apply to all agreements between Mushrumpmirami B.V. (studio) and the client over recording, mixing, mastering, podcast production and related studio services in Amsterdam.
Specific terms in a quote or order confirmation override these conditions. By accepting a quote, you confirm that you have read these terms, the privacy policy and, where relevant, the cookie policy. A tour or orientation via contact alone does not create a contract.
2. Definitions
| Term | Meaning |
|---|---|
| Consumer | A natural person acting for purposes outside trade, business or profession. |
| Business client | A legal entity or professional, such as a label, producer or agency. |
| Quote | A written proposal describing the service, date, duration, price with and without VAT, deposit and any special terms. |
| Session | Reserved studio time with an engineer, e.g. vocal recording or band recording. |
| Post-production | Mixing, mastering or edits such as podcast recording, delivered outside the live session. |
| Business day | Monday to Friday, aligned with Mon–Fri 10–22, Sat 11–18; public holidays when we are closed do not count toward day-based deadlines. |
3. Quotes and formation
Requests via contact, phone or email usually receive a quote within 1 business day(s). Quotes stay valid for thirty days unless a shorter period is stated.
The contract is formed when you accept the quote in writing (email is enough) and pay the deposit in article 5. Until then, a held slot is non-binding and may be offered to someone else.
We may decline a request for a reasonable reason, for example when the project does not fit our rooms (maximum 6 musicians at once), safety is at risk, or the booker is under 16 years without proper consent.
4. Prices and VAT
Prices on the website and in quotes are in euros. Consumer prices include 21% VAT unless marked ex VAT. Business clients receive invoices with VAT split where required; net amounts follow tokens such as €78.51.
Guide amounts: vocals €320 (half day), band €750 (day), mix per track €185, master per track €78, podcast session €295. Extra work outside the quote — additional hours, extra revisions or rush delivery — is confirmed in writing beforehand.
Band overtime after a day rate is billed at €135 per hour when you book extra time and capacity allows.
5. Deposit, invoicing and payment
Reservations require a deposit of 25% of the quoted total including VAT. The deposit is offset against the final invoice.
Consumers pay the balance on the session day or on delivery of post-production, as stated in the quote. Business clients pay within 14 days of the invoice date unless agreed otherwise.
If payment is late, we may withhold final files until outstanding amounts are settled. Statutory interest and reasonable collection costs may apply under Dutch law.
6. Cancellation, rescheduling and no-show
| Timing | Effect |
|---|---|
| More than 7 days before the session | Free cancellation or move; deposit refunded within 14 days if you cancel. |
| From 7 days down to 72 hours before start | One free reschedule within three months; if you cancel, the deposit compensates the held slot. |
| Within 72 hours or failure to attend | The session fee for that slot remains due unless force majeure in article 15 applies. |
Send requests in writing to [email protected]. Late arrival shortens the session without extension when the next slot is booked.
7. Right of withdrawal (consumers)
If you are a consumer and conclude a distance contract (online, phone or email), you generally have fourteen days to withdraw without giving reasons, unless a legal exception applies.
For services on a fixed date or period — such as a booked recording session — withdrawal may lapse once performance has started at your express request within that period. Fully customised post-production (for example a finished mix to your unique brief) may also be excluded once delivered.
To withdraw within the statutory window, send a clear statement to [email protected]. We refund within fourteen days using the same payment method, minus any proportionate amount for work already supplied where the law allows.
8. Studio sessions
The studio opens according to Monday to Friday 10:00–22:00, Saturday 11:00–18:00. Closed Sunday. By appointment only.. The studio is on Weesperzijde in Amsterdam East. From Amsterdam Amstel station it is about an 8-minute walk along the Amstel. Tram 12 stops nearby; metro lines 51, 53 and 54 serve Amstel. On-street parking is limited; bike racks are right outside the entrance. Visits are by appointment only.
Up to 6 musicians may play together in the live room. Bookers aged 16 or older may reserve independently; younger participants need written parental consent and an adult present throughout.
Treat gear and rooms with care and follow engineer instructions. Smoking and vaping indoors are not allowed. We may stop a session for unsafe behaviour or serious disruption; the slot fee remains due. Damage caused by intent or gross negligence is charged to you.
9. Post-production, revisions and quality
Mixing and mastering are creative services; we deliver competent work to the quote, not a guaranteed commercial outcome. 2 revision rounds per mix or master project are included by default, with one round meaning a single bundled feedback list. Further rounds or a new artistic direction after approval are quoted separately (for mastering, for example €35 per extra round).
Practical delivery tips: delivering mix stems and mastering rights and delivery.
10. Files, delivery and archive
Unless the quote says otherwise, we deliver digital files (for example 24-bit WAV) via a secure download link. Post-production timelines start once we receive complete, usable source material.
We retain session and project files for 6 months after the last project activity, then delete our copy. Back up your assets within that window. Extended storage can be agreed in writing for a fee.
Until full payment, we may withhold final masters or exports; working files follow the same archive rule.
11. Intellectual property
Your material. Compositions, lyrics and samples you supply remain yours or your licensors’. You warrant that you hold the necessary rights and indemnify us against third-party claims.
Recordings. Parties assume that you obtain rights to recordings made for you once fully paid, within what the law allows. The studio does not claim copyright in your music; our role is technical production.
Portfolio. We mention your artist name or titles in references only with your prior written consent.
No AI training. We do not use your recordings to train machine-learning models and do not clone voices without express written permission from the person concerned.
12. Liability
Our liability for breach is limited to direct, foreseeable damage and, for business clients, capped at the invoice amount for that assignment (ex VAT), except where mandatory law says otherwise. Indirect loss, lost profit or missed release dates are excluded unless caused by intent or wilful recklessness.
This does not limit liability for death or personal injury. Consumer rights remain unaffected.
Your own instruments and gear stay at your risk; insurance is recommended. See also the disclaimer.
13. Conformity and complaints
If a delivered audio file has an obvious technical defect (corrupt file, wrong format per quote), tell us within a reasonable time. We repair or re-deliver at no extra cost when the fault is on our side.
Complaints about performance or billing go to [email protected] with the quote reference. We acknowledge within 1 business day(s) and aim to resolve within fourteen days. If that fails, we discuss next steps, including consumer mediation where applicable.
14. Personal data
We process contact and booking data under the privacy policy. Business clients who supply guest or artist data may need a data processing agreement. The contact form uses FormSubmit in the United States; see legal notice.
15. Force majeure
In force majeure — extended power loss, severe public-health measures, or loss of essential equipment — we postpone work or either party may terminate for services not yet performed. Amounts paid for undelivered work are refunded; deposits for cancelled sessions are applied to a new date where possible.
16. Governing law and courts
Dutch law governs these terms and all contracts. Disputes with business clients go to the competent court in the Amsterdam district unless mandatory consumer rules designate another forum.
Consumers may also bring proceedings in their place of residence where permitted. We are not obliged to join a dispute board unless we confirm that separately in writing.
17. Final provisions
If a clause is void, the rest remains in force. Failure to enforce a right is not a waiver. We may amend these terms; the version dated 15 October 2026 applies to new quotes. If translations differ, the Dutch text prevails. Questions? Contact us or read the FAQ.
